Terms of Service

By accessing or using the Service you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.

You must be at least 18 years old and able to form a binding contract. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization, and “you” includes that organization.

ScoutVantage is a research and discovery tool. It organizes and analyzes publicly available App Store data — such as public charts, ratings, review counts, and update dates — to help you explore under-served niches and competitive dynamics. It exists to inform your judgment, not to replace it.

The Service is provided for informational purposes only. It is not:

• business, financial, investment, legal, or tax advice;
• a guarantee that any niche, market, or app will succeed, generate revenue, or perform in any way;
• a source of official, complete, real-time, or error-free data.

Metrics, scores, and “opportunity” signals are estimates and editorial judgments derived from imperfect public data, and may be delayed, incomplete, or wrong. Decisions you make based on the Service are your own.

Some features require an account. We use passwordless sign-in (a “magic link” emailed to you, or Google sign-in). You are responsible for maintaining access to your email and Google account and for all activity under your account. Provide accurate information and keep it current. Notify us promptly of any unauthorized use.

You agree not to:

• scrape, crawl, or bulk-extract data from the Service, or resell, sublicense, or redistribute our data or outputs as a competing dataset or product;
• circumvent, disable, or interfere with rate limits, caching, security, or access controls;
• reverse engineer, decompile, or attempt to derive source code, except as permitted by law;
• use the Service to violate any law, infringe intellectual-property or privacy rights, or violate Apple’s or any third party’s terms;
• upload malicious code, or probe, load-test, or disrupt the Service or its infrastructure;
• share, resell, or transfer your account or a paid plan’s benefits to others outside your organization;
• misrepresent the Service’s outputs as official Apple data or as guaranteed outcomes.

We offer a Free plan and a paid Pro plan. The features of each plan are described on our pricing page and may change over time. We may modify, add, or remove features on any plan; where a change materially reduces a paid feature you are actively paying for, we will give reasonable notice.

Paid plans are sold as automatically renewing subscriptions and billed through our payment processor, Stripe. By starting a paid subscription, you expressly authorize recurring charges and acknowledge the following:

• Auto-renewal: your subscription renews automatically at the end of each billing period (monthly or annual, as selected) at the then-current price, until you cancel.
• Price and frequency: Pro is offered at $29 per month, or $19 per month billed annually ($228/year), plus applicable taxes. Prices are shown at checkout before you subscribe.
• How to cancel: you may cancel at any time — before the next renewal — from the billing portal in your account settings (Stripe Customer Portal), with no phone call or email required.
• Effect of cancellation: cancellation stops future renewals; it takes effect at the end of the current paid period, and you keep Pro access until then.
• Billing descriptor: charges may appear on your statement as “Laya Vantage Systems” or “ScoutVantage.”
• Price changes: we will notify you in advance of any change to your recurring price; the new price applies to renewals after the notice period, and you may cancel before it takes effect.

We may offer a 14-day free trial of Pro that requires a payment method. If you do not cancel before the trial ends, your paid subscription begins automatically and your payment method is charged the disclosed price. We will send a reminder before your trial converts, stating that the trial is ending, the price that will be charged, the renewal frequency, and how to cancel. You can cancel any time during the trial from the billing portal. Trials are limited to one per customer unless we state otherwise.

You can cancel at any time as described above. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial periods, downgrades, or unused features. If you believe you were charged in error, contact us at [billing@scoutvantage.app] and we will review it in good faith. Consumers in certain jurisdictions (including the EU/UK and some U.S. states) may have additional statutory cancellation or refund rights, which these Terms do not limit.

You retain ownership of the notes, workspaces, filters, and other content you create in the Service (“Your Content”). You grant us a limited license to host, store, process, and display Your Content solely to operate and provide the Service to you. You are responsible for Your Content and for having the rights to it.

The Service — including its software, design, brand, text, scores, methodology, and compiled outputs (but excluding the underlying public facts and Your Content) — is owned by Laya Vantage and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal research purposes in accordance with these Terms. All rights not expressly granted are reserved. “ScoutVantage,” “Laya Vantage,” and our logos are our trademarks; do not use them without permission.

ScoutVantage is an independent product and is not affiliated with, sponsored by, or endorsed by Apple Inc.“App Store” and “Apple” are trademarks of Apple Inc., used only to describe the public data we analyze. Your use of Apple’s services remains governed by Apple’s terms.

The Service relies on third-party providers (for example, hosting, database and authentication, payment processing, caching, analytics, and AI processing). Your use of the Service may be subject to those providers’ terms, and we are not responsible for their acts or omissions.

Certain features (such as review-gap summaries) use third-party AI models to summarize publicly available information. AI output may be inaccurate, incomplete, or misleading, and should be treated as a starting point you independently verify — not as fact or advice. We do not warrant AI outputs.

THE SERVICE AND ALL DATA AND OUTPUTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY OF ACCURACY, COMPLETENESS, OR AVAILABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT DATA WILL BE CURRENT OR RELIABLE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME MAY NOT APPLY TO YOU.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LAYA VANTAGE AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOST PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO THE SERVICE — INCLUDING DECISIONS MADE IN RELIANCE ON IT — EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ALL CLAIMS IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THAT PERIOD, OR (B) US $100. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITS, SO THEY MAY NOT FULLY APPLY TO YOU.

You agree to indemnify and hold Laya Vantage harmless from claims, losses, and expenses (including reasonable legal fees) arising from your use of the Service, Your Content, or your breach of these Terms or of any law or third-party right.

You may stop using the Service at any time and delete your account. We may suspend or terminate your access if you breach these Terms, create risk or legal exposure, or for prolonged inactivity, with notice where practicable. On termination, your license ends and we may delete Your Content in accordance with our Privacy Policy. Sections that by their nature should survive (including 9–15 and 18) survive termination.

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and take reasonable steps to notify you (such as by email or in-app notice). Changes are effective when posted unless stated otherwise; continued use after the effective date means you accept the updated Terms.

These Terms are governed by the laws of the State of Colorado, United States, without regard to its conflict-of-laws rules, and the parties consent to the exclusive jurisdiction of the state and federal courts located there, except where mandatory consumer-protection law of your residence provides otherwise.

Informal resolution first: before filing any claim, you agree to contact us at [legal@scoutvantage.app] and try in good faith to resolve the dispute for at least 30 days. [If you choose to include binding arbitration and/or a class-action waiver, insert the agreed clause here after attorney review — those provisions have specific drafting and notice requirements and vary by jurisdiction.]
